The intersection of Name, Image, and Likeness (NIL) rights and U.S. immigration laws presents a significant challenge for international student-athletes. While NIL opportunities allow student-athletes to monetize their personal brand, international students on F-1 visas must navigate complex regulations that can place them at risk of violating their immigration status. This CLE program aims to equip legal practitioners with the necessary knowledge and tools to advise international student-athletes, universities, and businesses on the evolving NIL landscape while ensuring compliance with immigration laws.

Flavia Santos Lloyd has been in the immigration field for over 22 years – first as a paralegal and then as an attorney. She is a Certified Specialist in Immigration and Nationality Law by the State Bar of California. Flavia is the Founder and Managing Attorney at Santos Lloyd Law Firm, PC, a firm she started in 2016. Today she leads a team of 14 attorneys and over 40 support staff. Her practice focuses on a broad spectrum of immigration matters such as family-based, employment-based, extraordinary ability cases, naturalization, adjustment of status, consular processing, asylum, removal, and complex family matters such as waivers. Her primary focus and expertise is extraordinary ability cases. As she is also passionate about teaching, she teaches subjects tested in the California Bar Exam and Immigration Law at different law schools. She also devotes her time to scholarly work by writing research papers and presenting them at national and international conferences.

With more than 15 years of legal experience, Ksenia is recognized as one of the nation’s leading specialists in sports immigration and has vast experience representing athletes, coaches, and other sports industry professionals in connection with their applications for visas and permanent resident status.

Over the last few years, Ksenia has developed innovative legal solutions for international student-athletes pursuing “Name, Image, and Likeness” opportunities during their NCAA careers, some of which are documented in her book, NIL x Immigration. Her EB-1A victory for Olympic hammer thrower, Camryn Rogers, is recognized as the first-ever NIL-related EB-1A for an NCAA student-athlete and she was named by On3 as among the “13 Figures to Watch in the NIL Landscape in 2023.”

Ksenia is a frequently invited speaker at continuing legal education conferences organized by the American Immigration Lawyers Association and other organizations. She is the founder and interim director of the Sports Immigration Lawyers Association and the founder and conference chair of the annual Sports Immigration Law Conference. Her work in the sports immigration field has been covered by ESPN, TIME Magazine, and the Wall Street Journal.

Ksenia’s legal strategy and case production process prioritize much-needed travel flexibility for the athletes and leverage our internal sports expertise to minimize each client’s document production burden.
