Program Summary

A multitude of U.S. Government agencies have issued reports to Congress, guidance, and proposed rules/regulations regarding artificial intelligence (AI) and cybersecurity. Additionally, lawyers have been sanctioned for utilizing ChatGPT’s “fake cases” and at least one federal judge now requires attorneys appearing before him to certify that they either did not use AI or if they did that they can substantiate that they verified the content through traditional sources, such as PACER, Westlaw or Lexis. The purpose of this presentation is to explain the AI landscape, potential uses and liabilities, and provide suggestions for contract language in business associate agreements and other contracts.
