Program Summary

Session I - Risk management and brand strategy – Paul W. Reidl

The first part of this program explores how to protect the value of trademark assets: Best practices, risk management techniques, and how recent trademark case law influences brand strategy, risk management and business development. Participants will gain a deeper understanding of evolving legal standards around brand protection, including trade dress protection, fair use, and trademark dilution. The presenter will discuss how they can strengthen their trademark portfolio, minimize the risk of costly litigation, and identify new market positioning opportunities. This is designed for IP attorneys, in-house counsel, brand managers, and legal advisors, who have a basic understanding of trademark law. It will provide actionable insights into the intersection of law and business.

Key topics to be discussed:

  • Risk management strategies for the trademark portfolio
  • Key trademark litigation trends from recent federal court decisions
  • Impact of evolving case law on risk management
  • Practical application of fair use, parody, and descriptive term defenses
  • How businesses can lawfully capitalize on weakened or genericized marks

Session II - The art of enforcement: Practical playbooks for trademark protection – R. David Donoghue

As trademark case law continues to evolve, effective enforcement demands more than legal awareness— it requires a strategic blend of precision and adaptability. This second session delves into how litigators and brand advisors can translate legal developments into actionable enforcement strategies across all stages: Pre-dispute, litigation, and resolution.

Designed for practitioners who want more than a theoretical review, this program offers real-world guidance on crafting impactful cease-and-desist letters, conducting targeted pre-litigation investigations, building persuasive litigation narratives, and aligning enforcement efforts with broader business objectives.

Key topics to be discussed:

  • Trademark enforcement tactics that work
  • Litigation decision-making
  • Building the enforcement case
  • Litigation-proofing your brand
  • Private resolution vs. public litigation
